1. General Overview & Acceptance

   This Terms of Use and User Agreement ("Agreement") governs the use of TheBinBot device ("Device") and related services ("Services"). By purchasing, registering, or using the Device and Services, you agree to be bound by this Agreement. If you do not agree to these terms, you must discontinue use of the Device and Services.

2. Device Ownership & Usage
   • Users own the hardware but are granted a limited, non-transferable license to use the proprietary software embedded in the Device.
   • Users may register their Device under any user account and subscription.
   • The Device must be used only as instructed on our website. The software is proprietary, and any attempt to access, modify, or tamper with it is prohibited. However, users may format the Device’s memory and repurpose the hardware components.
   • The Device allows users to track scanned products and, with an active subscription, facilitate product placement in preferred grocery store or delivery service online carts.
   • Additional barcode scanners that meet TheBinBot’s specifications may be used, but only scanners or cameras sold by TheBinBot are guaranteed to be compatible.
3. Subscription & Service Access
   • The Service operates on a single-tier subscription model with a 90-day free trial. Subscription cancellation and device return policies are detailed separately on our website.
   • Signing up is free, and users can preview available shopping integrations before purchasing a Device or subscribing.
   • Without a subscription, users may scan items and track them via their online accounts. A subscription is required for product placement in shopping carts.
   • TheBinBot does not place orders but suggests items for the user’s preferred vendors.
   • Users are responsible for verifying cart contents before placing orders and must resolve any issues with their chosen vendor.
4. Data Collection & Privacy
   • Data collection, storage, and sharing practices are outlined in our Privacy Policy, available on our website.
   • TheBinBot complies with applicable privacy laws, including CCPA, and users may make requests regarding their data via the contact form on our website.
   • TheBinBot does not collect sensitive personal information as defined by applicable law.
5. Third-Party Integrations
   • TheBinBot integrates with third-party grocery stores and vendors to facilitate online shopping.
   • TheBinBot is not responsible for the actions, errors, or failures of third-party vendors.
   • All transactions occur directly between the user and their chosen vendor; TheBinBot does not process or fulfill orders.
6. Software License & Updates
   • The proprietary software is licensed solely for the purpose of placing products into online shopping carts.
   • TheBinBot reserves the right to update, modify, or terminate software access at any time.
   • Software updates will retain core functionality and aim to improve performance.
7. User Responsibilities & Acceptable Use
   • Users may not modify, tamper with, reverse-engineer, or resell the software.
   • The Device and Services must be used in compliance with applicable laws and regulations.
8. Warranty & Liability
   • The hardware is sold without warranties or repair agreements and is sourced from third parties. A 30-day return policy applies.
   • The software is provided "as is" without warranties of any kind.
   • TheBinBot is not liable for service disruptions, third-party errors, or inaccurate product recommendations.
9. Termination & Account Suspension
   • TheBinBot reserves the right to terminate accounts or suspend access if the Device or Services are used for purposes outside of this Agreement.
   • Users may terminate this Agreement by unsubscribing,, stopping the use of Services and contacting TheBinBot regarding their rights under applicable law.
10. Refund & Return Policies
    • Hardware returns are accepted within 30 days for a full refund. Further details are available on our website.
    • Subscription fees are non-refundable once paid. Subscription cancellation policies are available on our website.
11. Dispute Resolution & Governing Law
    • This Agreement is governed by the laws of the State of Michigan, without regard to its conflict of law principles.
    • Any dispute arising under this Agreement shall be resolved through binding arbitration in Michigan under the rules of the American Arbitration Association (AAA), except for small claims disputes, which may be resolved in Michigan state courts.
12. Changes to Terms
    • TheBinBot reserves the right to update this Agreement. Users will be notified of any changes via the email associated with their account.
